Kenya: Justice prevailed in a Court Ruling on Nairobi Dusit D2 complex attack in which terrorist suspects had a case to answer
In a significant stride towards justice, the Office of the Director of Public Prosecutions (ODPP) in Kenya has secured a major court ruling in the Dusit D2 Hotel terrorist attack case. On 21 January 2025, the Kahawa Law Court ruled that two suspects have a case to answer for their alleged involvement in the heinous attacks in the Dusit D2 in January 2019, which claimed 21 lives and injured several others. The Trial Court had directed that the evidence gathered from the mobile phones of the suspect’s was obtained without a search warrant be excluded, a decision which Prosecution challenged.
The High Court directed admission of electronic evidence obtained from the mobile phones of the accused persons and ruled that the evidence ought to be admitted. This decision followed a rigorous prosecution process led by an IIJ Alumnus, representative of the Office of the Director of Public Prosecutions in Kenya, during which 45 witnesses and experts provided compelling evidence, and which enabled to establish a prima facie case against the two accused persons.
